Q: Want support to get divorce without husband giving

I am a female hindu , was converted and married to muslim.i have two daughters. I have been working and taking care of family my daughter got married to hindu and I have reconvered to hindu religion. My husband has left home and not living with us since 1 and 1/2 year. Now I want divorce .he is not willing to give divorse .now how to get divorce in short time

Since your husband is not willing to give divorce, you need to file a contested divorce petition in the Family Court. Grounds available include desertion (he left you for more than 1 year), cruelty, and irretrievable breakdown of marriage. Since he has been away for 1 ½ years, you can proceed under Section 13 of the Hindu Marriage Act (if the marriage is treated under Hindu law) or under the Special Marriage Act if it was registered there. If both agree, mutual consent divorce is faster (6 months approx.), but if he does not agree, contested divorce may take longer. You should consult a local family lawyer immediately, file the petition, and request interim maintenance/reliefs for yourself and your children.

మీ వివరణ ప్రకారం, మొదటి వివాహం చట్టపరంగా హిందూ సాంప్రదాయ పద్ధతిలో జరిగితే, రెండో వివాహం మొదటి భార్య అనుమతి లేకుండా చేయడం హిందూ మ్యారేజ్ యాక్ట్ ప్రకారం చట్టవిరుద్ధం అవుతుంది, ఇది bns కింద శిక్షార్హం. మీ అక్క చట్టపరంగా రెండో భార్యగా హక్కులు పొందలేరు కానీ, ఆ వివాహం నుంచి పుట్టిన పిల్లలకు వారసత్వ హక్కులు ఉంటాయి. మీరు లేదా మీ కుటుంబం చట్టపరంగా చర్యలు తీసుకోవాలనుకుంటే, సాక్ష్యాలు (మొదటి వివాహ పత్రాలు, రెండో వివాహ సాక్ష్యాలు) సమర్పించి ఫిర్యాదు చేయవచ్చు.

Q: Got caught with 1g weed on July 2nd got bail once and its rejected.

The person who is arrested applied bail 1st time it is rejected and 2nd time also he applied bail but they are delaying coz the person is with his friend his friend got arrested its 2 or 3 time though the person is arrested 1st time still they are delaying to give bail.

If bail has been rejected once, a second application must highlight any change in circumstances. If your friend's repeated arrests are being linked with your case, it may affect your bail plea. You should file a fresh bail petition citing that you were arrested for the first time and are being unfairly linked to others' cases. Also, approach the Sessions Court or High Court under relevant provisions for speedy disposal. You may also file a writ petition under Article 21 for violation of your right to liberty due to delay.

Q: Husband and inlaws right on deceased women property

my wife expired leaving behing two flats. Her parents also expired. She had no children. two brothers and two sisters are alive. one of her sister claim her WILL was to distribute property equally among brothers and sisters. There is nothing in writing or any witness to this so called Will. Question: 1. How this property shall be distributed and in what proportion.What is the legal validity of this will. We are muslims and they don't want to consider this under sharia law

Since your wife passed away without leaving a written and witnessed Will, her property will be considered as intestate under Muslim Personal Law. In Islam, a Will (Wasiyat) is valid only up to one-third of the deceased’s property and must be in writing with witnesses. As no valid Will exists here, her legal heirs will inherit according to Sharia law.
