there are various judgments in this matter but the condition is whether you have proved in the court that your are not guilty,these are things of trail. and about alimony not granted to wife depends on various situations like her job and financial status and your financial status. and more or less you can't spare yourself from giving alimony, although it can be negotiated. for further clarification please feel free to contact me.

Sir you need to figure out some points before you go for divorce. 1. Do you want it mutual (is your wife ready for divorce) because if you contest it, that may will take long time. 2. Where do you want to file your case? This will depend where you live or where your wife lives or are you both in the same place. Is she currently in matrimonial house or parents house. 3.Do you both have children? if yes who wants their custody. 4.What were the items exchanged at the time of marriage. gold etc. Once you have clear understanding of above points you can consultant an advocate.

राजेश शर्मा बनाम राज्य उत्तर प्रदेश (2017) सुप्रीम कोर्ट ने इस मामले में धारा 498A के दुरुपयोग को लेकर महत्वपूर्ण दिशानिर्देश दिए थे। न्यायालय ने कहा कि इस धारा का दुरुपयोग बढ़ता जा रहा है और इसे केवल गंभीर मामलों में ही लागू किया जाना चाहिए। न्यायालय ने पुलिस को निर्देशित किया कि वे सभी मामलों में गिरफ्तारी से पहले जांच करें और इस धारा के तहत आरोप लगाए जाने से पहले विवाहिक संकट और घरेलू हिंसा का सही मूल्यांकन करें।
