Q: Judgement Of SDRC In a Property matter Of Sahara city homes at lucknow

Sir in 2018 I went to state forum against sahara City homes Lucknow in a property dispute.Court have the judgement in favour of me on July 2022 with handing over possession of flat with penalty of interest over the delay. But since July 2022 judgement is not being executed tii today. What should we do.On July 2025 I filed the writ in SDRC but on hearing 19th January 2026 there was no plea by sahara.Sir this is a case at lucknow(UP).

Advocate Madhav Chaturvedi answered
Sahara cases often involve complex corporate structures, ongoing moratoriums, or specific registry conditions, we need to see your complete case file before suggesting anything further. To provide you with the most accurate strategy for your next hearing, please share the following documents:The original favorable judgment copy dated July 2022.A copy of the Execution Application/Writ filed in July 2025.The latest Daily Orders/Proceeding Sheets from the SCDRC (especially the order from the January 19, 2026 hearing).Once we review these documents, we can pinpoint the exact application to move forward with to pressure the builder for possession and dues.

Q: Agricultural land FOR SALE in Jhansi India

I am unmarried daughter and my inter is married. My father away. My agricultural land is in UP. Lekhpal says I am only the legal heir and my sister is opposing that. What is true ?

Advocate Madhav Chaturvedi answered
To provide you with an accurate legal opinion regarding your father's agricultural land in Uttar Pradesh, I need to clarify a few critical details based on your query:Date of Passing: On what exact date did your father pass away? This determines whether the UP Revenue Code, 2006 or the older ZA & LR Act applies.Family Structure: Is your mother still alive? Do you have any brothers? Under Section 108 of the UP Revenue Code, the widow, sons, and unmarried daughters typically share the inheritance equally.Sister’s Marriage: Was your sister already married at the time of your father's death? This is vital, as the law prioritizes unmarried daughters over married ones.Existence of a Will: Did your father leave any written Will, or is this a case of natural succession (intestate)?Land Status: Is the land classified as Bhumidhari with transferable rights?Under current UP law, the Lekhpal is often correct that unmarried daughters have a preferential claim. However, if your sister has filed a formal objection, you must prepare your documentation

Q: Ex parte order by family court

Dear sir/madam, my wife filed a divorce petition in 2022. I appeared in court most of the times but on 2 dates 21 aug and 16 october 2024, i could not appear in family court due to medical reasons. Court has ordered for exparte. My question is if exparte order is passed then divorce decree will be given to herorboth of us. If decree isgiven only to her then will I be considered divorced. I mean will I get some certificate/written confirmation by court that i am divorced or how will I get divorce

Advocate Madhav Chaturvedi answered
Agar aapka case exparty decide ho gaya hai to aapko Ek recall application lagaani padegi app ko yeh sabit karna padega ki aapki use Din tabiyat theek Nahin Thi, is Karan aap Court mein date attend Nahin Kar Paye. Agar Court aapke is Baat se satisfied Ho Jaati Hai To aapko is ka benefit milega aur order recall ho jaega
