Contested divorce from husband

18-Sep-2023 (In Divorce Law)
Hii, My sister got married in july 2018. But after 6 months she realised that her husband is not educationly qualified what he has mentioned in his matrimonial bio data. Also huge difference in salary. She was also suffering from mental torture from her inlaws. (Mainly related to her poor family background.) Now since 1 year she is staying with her parents. We didn't file any complaint because meetings were conducted through mediators. She is working in a company. No child. We tried for Mutual divorce but not succeed. What are other ways to get divorce ASAP. How much time will take? Will mediation process help? How to apply?

Definitely mediation will work if opposite party is having that kind of maturity. If they are not enough proper then you can file divorce Petition on the ground of cruelty and also can file criminal application under Domestic Violence Act.

You have many legal options with you but if you are interested only to get divorce then you can file divorce petition on the ground of cruelty. However, her husband may contest it if he doesn't want to give divorce. If contested then it will take time. Mutual divorce can be done with in 6 months but contested will take longer time.
