Clarifications on Mutual Consent Divorce case

01-Nov-2023 (In Divorce Law)
Hello advocates at lawrato, I am looking to file for an MCD in Bangalore. 1. Could anyone please share details if the legal system supports the wife in choosing the location/city for filing the proceedings? 2. As the place for registering this marriage was in a different city, is it necessary to provide the divorce decree in the office where the marriage was registered? Do both parties have to be present in person for this? Thanks in advance.

sir there are 3 places where you can apply for divorce, firstly in a place where marriage is performed, secondly where both last resided togather and thirdly where the wife resides, yes court will insist both parties to be present, as mediation and conciliation proceedings take place, yes but it can be avoided if online proceedings are conducted through video conferencing etc.

case of virtual concentrated divorce the parties do not have a freedom to choose there you restriction. the jurisdiction for filing a mutual concentrate divorce case is either the jurisdiction where the marriage was held or the place of the last residence of the couple.

Dear Sir, If it is mutual divorce then presence of both the parties is necessary. If it is contesting divorce filed by the husband then he can file in his own city and wife has an option to go to High Court or Supreme Court for transferring the case to her native place.
