You have the right to file for custody of your child in family court, even if you were not legally married to the woman who gave birth to the child, as Indian courts focus on the welfare and best interest of the child. Since the child was born using your sperm, you can seek to establish paternity and apply for custody or visitation rights.

Mr Prasad based on your query you have legal rights as the biological father of the child . Since the child is born out of your sperm via IVF. You can approach the Family Court in Hyderabad seeking custody or visitation rights under the Guardians and wards act. Your exalted or threatened immediately file a criminal complaint under section 323 for IPC and also SC /ST atrocities act. Since caste based abuse is involved you may also approach the State Human Rights Commission. Consult a lawyer immediately. Gather All Medical records evidence of relationship and Threats received for legal proceedings.

you will have to file a case for custody of child and should have sufficient evidence of events which you are claiming . it doesn't matter who they are once you file a case. but was there a earlier agreement to keep the child with her, or the reasons for you live in relationship is this important

You are the biological father, so you have legal rights over the child under Guardians and Wards Act. Immediately file a police complaint for assault, threats, and kidnapping under IPC Sections 323, 506, and 361. Approach the family court for custody/visitation rights, presenting proof of paternity (IVF records and DNA if needed). Caste is irrelevant to your parental rights. If police don’t act due to influence, submit a written complaint to the SP or file a petition before the Magistrate under Sec. 156(3) CrPC.
