Q: Need advise on how to proceed with previous cases and now with this

My husband cheated me before mrg and i filed 376,417 and sc st cases. After 1 yr he came back and married me (hindu mrg act). Now from 1 yr he and his mom are torchering me. They abuse and beat me. My parents says me to adjust with them. I need a help on how to deal with this.

Advocate Sujith Kuchipudi answered
You have strong legal remedies available. Since your husband and mother-in-law are physically and mentally harassing you, you can:1. File a Domestic Violence (DV) case under the Protection of Women from Domestic Violence Act, 2005 seeking protection, residence rights, and maintenance.2. File a complaint under Section 498A IPC for cruelty and physical abuse.3. If there are serious threats or assaults, immediately approach the local police station or Women Police Station and request protection.4. Collect evidence like audio recordings, messages, or medical reports of injuries.5. If you want to end the marriage, you can file for divorce under Section 13(1)(ia) HMA citing cruelty.Since you already have past cases like 376 & SC/ST, this will strengthen your case if they continue harassment.Act quickly — don't wait, as delay may weaken your position. Would you like me to guide you step-by-step on filing the DV and 498A complaints?

Q: evidence not available yet pending in other court

In one court my divours on adultry and cruality at the stage of judgement.based on some evidence the judgement will be favour to me In another court there is an dvc case pending on me in that case a have fileed a crmp for my spouse bank statement it is an crucial evidence My dout is if opposite party prefer to go for appeal in hicourt after trial court judgement can i add that bank statement evidence in hicourt which is not available during trial stage and pending in dvc

Advocate Sujith Kuchipudi answered
Yes, you can submit the bank statement at the High Court stage, but only with the court's permission. Under Order XLI Rule 27 CPC, additional evidence can be allowed in appeal if:1. The evidence was not available despite due diligence during the trial.2. It is necessary for the court to pronounce a fair judgment.3. It has a direct impact on the case outcome.Since the document is currently pending in the DVC case, you must:File an IA (Interlocutory Application) in the High Court explaining why it wasn't produced earlier.Attach certified copies once received.Show that the evidence is crucial to proving adultery or cruelty. The High Court will allow it if it finds it essential to deliver justice.

Q: Objection From Parents When I Sell Property

I got old construction house as gift Deed from my mother at 2021 than I demolished and constructed new hose last 2 years back than I sold property to my wife.last 3months back, now issue is my self and my wife wanted to sell property to others but my parents are objection , they are saying don't sell, how to proceed?

Advocate Sujith Kuchipudi answered
Since you got the property through a registered gift deed, it is your absolute property under Section 14 of the Hindu Succession Act. After selling it to your wife through a registered sale deed, she became the legal owner. Your parents cannot legally object unless they prove fraud, coercion, or lack of free consent in the transfer.Proceed by:1. Ensuring all previous deeds (gift & sale) are properly registered.2. Serving a legal notice to your parents about their objection.3. If they continue to interfere, file a civil injunction suit to restrain them from obstructing the sale.Consult an advocate to verify the title and handle documentation before final sale.

Manakondur Dist karimnagar

Advocate Sujith Kuchipudi answered
You can file a petition under Section 482 CrPC or writ petition in High Court seeking directions to the police to complete the investigation and file the charge sheet. Since it’s been over a year, this is unreasonable delay. You can also send a written complaint to the SP/Collector, and mark a copy to the DGP and Human Rights Commission. Collect the FIR copy and details of IO changes to strengthen your case.

Advocate Sujith Kuchipudi answered
You are facing domestic violence under the Protection of Women from Domestic Violence Act, 2005 (DV Act). You can file a DV case in court seeking protection, residence, compensation, and custody of your child. Also, you may lodge a police complaint under Section 498A IPC for cruelty and harassment. Collect evidence like call recordings, messages, and witness statements. Approach a Protection Officer or Women’s Helpline immediately for safety and legal support.
