I need a legal opinion for sending a divorce notice to my in laws I was married in the year 2009 (arrange marriage)and have a son of 9 years old... My husband at present is under treatment for mental illness .For the past three years we were living separately due to his alcoholic addiction and other problems created by my in laws .. Now he had this mental disorder where he is not aware of his surroundings and sleeps and eats anywhere he feels like .. Finding him uncontrollable my inlaws has arranged a cab and had him left in my place in coimbatore...Because of his mental illness I was not able to convince him to return to my In laws house . And I have no other option except to get him admitted in the HOSPITAL FOR MENTAL ILLNESS.For the past three months he is taking treatment and is now in the rehabilitation centre ... This disorder has occurred earlier in 2011.
the mental illnesses can be a good ground for filing the divorce. the person has not mentioned whether she is Hindu or other religions. because of this correct legal act can not be mentioned here. the person shall be filed a divorce

First please try to understand that you have to send the diverse notice only to your spouse and not your in-laws. Secondly it is for you to file a diverse petition on the grounds of mental illness of the spouse and it is as you say he is suffering from mental illness, you can brew before the court. Thirdly with regard to his illness, you can take him to Kilpauk mental Hospital where in detail medical assistance will be provided to him free of cost.
