In dv case you can claim maintenance for self and children. Otherwise file seprately.in divorce case filed by husband you need to contest strongly through a lawyer. And in that case you can claim maintenance for self and children.

In the pending divorce case, file an application under section 125 of the Criminal Procedure Code. Your lawyer will be able to do. Through that you can ask for interim maintenance. Also, if your husband has flied a divorce case in Delhi, move an application in the Delhi court and have it transferred to Indore-the court will transfer it.

If your husband fails to maintain you and your children, you are entitled to file a suit under Section 125 Cr PC in a competent court. You can do so in Indore where you are staying presently or at your last place of residence together.
You have fair chances of getting relief. You may file the maintenance petition and then request court to give you interim maintenance.

file an application u/s 24 of HMA Act for this and above all file a special leave petition in the supreme Court t transfer the divorce proceeding to Indore as you cannot come on every date to Delhi and you are staying with your parents and is dependent on them. Question: I filed domestic violence and maintenance case in indore district Court on my husband and in law's. At present I am living with my children at my parents house in indore. After this my husband file divorce case in Delhi family Court. Now my question is how can I get intrim maintenance for me and my children's. I am not working?
