Since last 2 yrs I have been contesting for divorce but still it's pending. Recently I have been transferred to other state. Also I have 1yrs old daughter. Who access has been granted to my husband. But after shifting to other state where my relatives are staying it will be difficult for me to come and attend the court in Mumbai along with my baby. So what are the possibility of getting my case transferred and how to give the Access.
This is my response to you:
1. You can transfer the case by filing the transfer petition in the Hon'ble Supreme Court;
2. Since it is itner-state therefore Supreme Court has the authority to grant the transfer;
3. Cite good reasons and file the petition in the Court;
4. The Court where it is transferred then will decide the terms and conditions of the custody and visitation rights of the child.
5. Consult a good lawyer and do the same.
