Based on the facts stated, the husband should first make sincere efforts to resolve the dispute through elders or mediation and record such efforts. If the wife is unwilling to return unless the husband resides separately, the issue depends on the facts and circumstances. If reconciliation fails, the husband may issue a legal notice calling upon her to resume cohabitation. Depending on her response and the surrounding circumstances, appropriate legal remedies, including a petition for restitution of conjugal rights or other proceedings under applicable family law, may be considered after obtaining proper legal advice.

hi if she is not returning to her marital home then you could file petition in court for restitution of conjugal rights and if she is not coming despite legal notice then you could file petition for restitution in court

The wife cannot legally compel the husband to live separately from his parents unless there are genuine and provable circumstances such as cruelty, harassment or safety concerns. If you have already expressed willingness to establish a separate residence within a reasonable time and she still refuses to resume cohabitation, preserve all communications and issue a formal legal notice calling upon her to rejoin the matrimonial home. If she continues to stay away without sufficient cause, you may pursue appropriate legal remedies, including a petition for restitution of conjugal rights or other reliefs available under the applicable family laws, depending on the facts and evidence.

A spouse cannot be compelled to live in a joint family against their wishes. At the same time, insisting on a separate residence immediately may not by itself amount to cruelty or desertion. It is advisable to first attempt reconciliation or mediation. If your wife continues to refuse to resume cohabitation without sufficient cause, you may explore appropriate legal remedies, including restitution of conjugal rights or other matrimonial proceedings, depending on the facts.
