Breach in notarized divorce agreement

08-Sep-2023 (In Divorce Law)
My wife and I mutually divorced by notarized agreement on 500 stamp paper in 2016 after 10 years, we seperated from 1st year. We had many cases on eachother and we had withdrawn that as well . I remarried in 2017 and I have a son from my second wife. I had given 15lakh rupees for my daughter (16yrs now) Fixed Deposit at that time and my wife could only use interest as per agreement . I have come to know from a mutual friend that she has broken fixed deposit and using that money for her own self. I want to sue her because she had filed a false 498A on me and my family and my family suffered a lot because of her. But some of my friends say that she can also sue me for second marriage because our divorce was not done in court. I am a Hindu from Gujarat district.

First of all, notarized divorce is not valid in the eye of law.

your wife is still your wife.

if she is unmarried then your second marriage is null and void.

she can file a criminal case against you for second marriage.

your notarized document will help you at some extent but it's not a full proof protection.

You should file a divorce case on the basis of mutual consent as well as and on the basis of notarized document.
