05-Sep-2024 (In Divorce Law)
If a girl has filed case under section 498a and NBW has been issued then bail applicable and what is the cost? Also if in charge sheet names of family members are there but it is mention as no evidence then is it necessary to take AB for them as well? Lastly is surety compulsory to take AB?

In 498a criminal case bail is necessary after chargesheet has been filed. It is required for all accuseds named in the chargesheet. irrespective of evidence. it is better to get regular bail in this situation which usually requires 2 sureties.

Hello there,

you must move and application for Anticipatory Bai application because the NBW might is converted to BW and arrest might take place depending on the status of the case.

also for your family members who are named in the FIR should apply for Anticipatory Bai.. this Will ensure mental peace and they can live peacefully.. you can file an application either in the Session court under section- 483 BNSS or s.- 439 CrPC or in the Hight Court under the same section

once NBw has been issued, Court would hardly gives anticipatory bail, rather shall direct to come for regular bail.
just take a direction from High 3yhen after move an application for bail in court.
498a is mostly bailable , if you try with better advocate ,and surely will get bail

yes you can go for anticipatory bail on ground of apprehension of arrest by police or by court. surely you got AB and you need to file two surety if court concern or demand. it's a best way for taking regular bail.

You can challenge the charge sheet if no evidence is available, the name of the other family members struct down from the chargesheet. The cost of all these may vary from advocate to advocate.
