Alimony and maintenance , husband wife living separately

Husband and wife have physical fight . now living separately for approx 8 months. there is a 5.5 year old boy from this wedlock who is staying with his father. Husband salary around is 1 lakh .Husband stays with her father , mother . wife salary is approx 25000.wife is only daughter and from last eight month staying with her father.she has no body in family apart from his father. Is she eligible for alimony or not . if we go out for mutual divorse at what amount should husband offer.

As you have mentioned in your problem that there was a fight between your husband and wife, due to which both of you are living separately from each other for eight months and you have a 5 year old son, he is living with your husband and you. You are living at your father's house separately from your husband and your husband

yes, wife shall be eligible for the alimony. alimony is of two types first is monthly second is permanent alimony. the quantum of alimony depends upon financial capacity of husband and demand of wife.
