Respected as you asked why you need to pay maintenance? 1) see per hindu law, it is an morel obligation on the part of the husband to look after his wife and the section 125 also signifies the same. Hence court will pass an order of maintenance on this basis. 2) See she can demand more than normal. but the court will look into your income and expenditure before deciding the maintenance. apart from if she is capaable to maintian herself then court will also look into her income too while deciding the issue. normally she may get a portion of your income only. it also applies for permanent alimony. 3) Yes you can also claim maintenance in case if you unable to maintaina yourself. to answer your question, detail discussion is required. if you already engaged some resepctive advovacte contact them or interested, you can contact us via this LawRato plat form.

The SC has set a benchmark for maintenance to be paid by a husband to his estranged wife, stating that 25% of his net salary might constitute a just and proper amount of alimony. There are certain other grounds also for calculation of maintenance total monthly income of both spouse, educational background of both the spouse etc. As, the case of husband claiming for maintenance mentioned as per Section 24 of the Hindu Marriage Act, defines a deserving man means who does not have an independent income sufficient for his living and support and does not have the necessary expenses for the proceedings can claim maintenance from his wife can afford to do so.

Have one of you or both filed case for separation? If a mutual consent case has been filed then one cannot claim from another, if you are discussing to file, then alimony will be according to your capacity. If you are filing ha if you have no reason, intention or capacity to pay you should have good reason.
