Advice for Divorce without having mutual consent and custody of child

1. We both are hindu family. Got married in 2018 and having two kids at present. One is 3 year old and another one is 8 months old. My wife is not giving mental peace to me since 2019. Almost every second or third day she is making scene and giving me warning to make a legal case against me and my family on the ground of cruelty and abuse. She always tell that she is waiting for time, the facts is since marriage we were living aboard without presence of parents. We just came to india in 2020 . I just want to protect my family and want to end this relationship if it going to be continues like this 2. I also wants to have custody of my childs . What are the possibilities to have thoes

If your wife is inflicting mental cruelty upon you then on this ground there is a provision under Hindu marriage act to proceed for divorce. Also she is proven to be abusive or mentally unfit for the welfare of the child then the custody can also be taken from the court. For any further legal assistance please feel free to contact

If your wife’s behaviour is not intolerable towards you then you can always file a written complaint against her in the police station of your area. And if want to just end this relationship then it’s better to go for it mutually because it is less money & time waste. As far as the custody of the children is concerned the fact that your both the children are minor can’t be ignored. For more legal assistance I am just a call away.

It seems your wife is threatening you and your family of false implication. In this scenario we would advise you to file An intallah peshbandi application with the concerned police authorities through a lawyer as a precautionary measure. You may thereafter file a petition seeking divorce on the ground of mental cruelty.

hello clients as i can sè your issues is seems to be very much urgent issue. in this matter divorce is possible as well as the custody of the both childrens are also possible for you to get . in tnis matter we have to move legally in the way tht we get succeded in our motive . mutual is not seems to be possible in any way we hav eto move for contested divorve only . but we can get it in fovour on the basis of the evidences .

You need to take a divorce from your wife in a court of law and u cAn also take custody for ur kids or visitation but u will be liable to pay for maintenance for ur kids and wife incase she is not working u can take a detailed legal advise and even if u r living outside India it is no problem in ur taking a divorce we have Handled such cases
