What to do my friend has been falsely implicated under IPC

02-Jul-2023 (In Criminal Law)
My friend has been falsely implicated in the 12 pocso act, 506,509,325IPC sections. It was a simple argument with a labor family in the vicinity which turned into fist fight and suddenly the labor girl (age 15 in the year 2015 and now married in the village) came in between and ended up getting hit on ear but police influence this labor family and put these charges against him and filed FIR. What to do?

If you have something to prove/show that this is abuse of process of law in that event only you may have a chance of seeking quashing of the said FIR and/or convince IO that no case is made out, otherwise you may have to face trial and cross examine witnesses.

Sir,
if the accused has not been arrested yet, then you have to move an anticipatory bail application under section 438 CrPC.
You may file a counter complaint against the wrong doers. for more information feel free to have a word with me.

Dear Friend

These are serious offences, specially Sexual Harassment of Child under Section 12 of POCSO Act. Anyhow, from your narration of facts this offence is not made out, and clearly there is lie writ at large. You must immediately approach High Court for quashing of FIR under Section 482-CrPC.

Since you have not stated any information regarding other aspects, including Bail, etc. I am not in position to give any advice for the same.

Do not delay action. God Speed!

If he is arrested, then you should apply for his bail and collect evidence of his innocence. In case he is safe, then anticipatory bail is required. You can contact us with complete case details to get proper guidance.
