आरोप पत्र खारिज करने के लिए उच्च न्यायालय CrPC 482 के अंतर्गत अपनी अन्तर्निहित शक्तियों का प्रयोग करता है I यदि उचित कारण मौजूद हैं तो उच्च न्यायालय कभी भी आरोप पत्र को खारिज कर सकता है I धारा 376 संगीन धारा है इसलिए समुचित कारण का मौजूद होना आवश्यक है I

Yes aap highcourt move kar sakte ho. usse pehle trial court me discharge application bhi laga sakte ho. Discharge application agar reject hota hai to uski appeal bhi kar sakte ho. Trial court me reinvestigation ya further investigation bhi karwa sakte ho. Sabse better option kon sa hai wo aapka advocate hi batayega.
