seek anticipatory bail from the concerned district judge court. if the provision of anticipatory bail is not applicable in your area then file writ petition in concerned high court challenging the maintainability of the criminal case.

you can move an anticipatory bail fist and then you can get the proceeding stay once the charge sheet is filed and summon is issued with all your valid defences along with relevant document the anticipatory bail will be filed in lower court and rest of the proceeding will be initiated in high court

Firstly if there is a provision of an anticipatory bail in your state then you may avail the legal remedy of anticipatory bail or in alternate you may file a petition before the Hon'ble High Court for seeking an stay upon your arrest and thereafter you have to face a trial in case Final Report is not filed before the magistrate.
