can you tell me your location to determine court jurisdiction. You can file a criminal case under 279 IPC & 338 IPC and you can also file a suit for compensation against the driver and insurance company from MACT

You will need to file a case before the mact claiming for compensation. also you may file a police complaint against the truck driver/ owner under the relevant sections of IPC. if the vehicle is insured, the insurance company will pay, otherwise the owner will be required to pay.
