Query regarding status of complainant if an FIR is withdrawn.

20-May-2023 (In Criminal Law)
My question is regarding a scenario where for example, if there are 5 complainants who had lodged an FIR or a complaint on the same matter together, and then anyone of them withdraws its complaint/FIR back, then what will be the situation of that person? Will he still be considered as a complainant or witness? And will the position or situation/status of other complainants change?

hello client as you are saying tht out of 5 complinants 1 person withdraws hi complaint in this matter once the Fir is registered ans tht is also for same offence 5 Fir is been registered in this matter 1 fir can can not be withdrawn for tht it need quashing process so there will not be no change in status unless and until fir is not quashed . so you are still in problem . you can come out of issues but it needs proper proceedi g to be followed.

The question cannot be answered properly in general without knowing the facts and circumstances. But if the main complainant is ready to take back the complaint, the case against you will be quashed and other witnesses cannot do anything if there is only one fir.

the person who has taken his FIR back will not be treated as the complainant and he will not be required to be produced in the court of law. however if the other persons admit him as the witness then he is required to be produced before the court of law as a witness

Remaining 4 people can still pursue their complaint or FIR. It's not like if one of the complainants has withdrawn then remaining people can not pursue their case or FIR. Four people will be enough to proceed further
