Property dealer threatening to seize assets over illegal 12% monthly i

14-Jan-2026 (In Criminal Law)
Context: Palam, SW Delhi. Local property dealer lent my father ~2.6L at 12% per month (144% p.a.). He gave a 10-day ultimatum, threatened to "forcefully sell our assets," and said he'd "do something bad" if not paid. The threat was verbal. An earlier abusive WhatsApp text was deleted. His shop is in our gali. He has local influence. Problem: We have no recorded proof of the threat. We're willing to repay the principal + fair interest, but fear violence if we complain and he guesses it's us (lik

Hi there, at first you must begin with filing a complaint with the police (online via Email). Post the complaint registration you should file a case of cancellation of documents. It's advisable to contact me and provide requisite details to assist you better and provide appropriate legal recourse.

The interest he is charging is illegal and his threats are a serious offence, so you should not deal with him alone or in fear—first write down all details of what he said, when and where, and who heard it, then quietly file a written complaint with the Police about the threats and harassment, and if you are scared of local pressure, send the same complaint to the ACP/DCP so seniors are aware; at the same time, through a lawyer, send him a notice saying you are ready to pay back the original money with fair, legal interest but will not accept illegal pressure or violence—this way you show good faith, create official protection on record, and reduce the risk of him harming you.

Charging 12% per month and issuing threats is illegal. Pay only via bank transfer with written receipt, offering principal + reasonable interest. Preserve any calls/messages and file a police complaint seeking protection.

File a Civil Suit for Permanent Injunction along with Mandatory Injunction to restrain the property dealer from threatening, harassing, visiting the residence/workplace, or using any force/pressure for recovery or “forceful sale” of assets. Move an urgent interim injunction application under Order 39 Rule 1 & 2 CPC seeking immediate protection and restraint orders on the first/early hearing. Submit a written complaint/DD entry at PS Palam to create official record of criminal intimidation and unlawful recovery pressure; if police does not act, file an application under Section 156(3) CrPC (or BNSS equivalent) for directions to register and investigate. And Pay money to him online through digital mode

Interest at 12% per month is illegal. Verbal threats amount to criminal intimidation. First, repay principal with reasonable interest via bank/cheque. File a confidential police complaint or PCR call if threatened; law protects even without recordings.
