Judge will take action only when your advocate will proceed case propery. Don't take lightly to this POSCO Case, in POSCO hardly 5 percent are getting acquitted. First change your advocate and appoint proper advocate ad tell him to file warrant on witnessses after checking summmons report, then to cancel witnesses ..

once summons report comes in negative, the Court can dispose the matter for want of prosecution. You should firstly check in the court's file whether any summons report has been received or not. If it is received in negative, then you may file an application for disposing off the case for non appearance of the Complainant/Victim. In case you require further legal assistance you can approach me.

Subject: Delayed Proceedings in POCSO Case – Non-Appearance of Victim and Informant I understand the frustration and stress you are experiencing due to the delays in your case under the Protection of Children from Sexual Offences (POCSO) Act, Sections 7/8. When a trial gets delayed due to the non-appearance of key witnesses like the victim and informant, it can create unnecessary hardship for the accused. Here is how you can address this situation: 1. Right to a Fair and Speedy Trial: Under the Indian legal system, every accused person has the right to a fair and speedy trial, as provided under Article 21 of the Constitution of India. The POCSO Act also emphasizes that cases under this law should be disposed of expeditiously, and Section 35 of the POCSO Act mandates that evidence of the victim must be recorded within 30 days from the date the Special Court takes cognizance of the offense. The constant delay due to the victim and informant not appearing in court violates your right to a timely resolution of the case. 2. Non-Appearance of Victim and Informant: If the victim and informant have been summoned multiple times but are still not appearing, this can lead to an unnecessary delay in the proceedings. The court has the power to enforce the appearance of witnesses .
