Out on bail want to know some legalities.

Hey i am out on bail.My case is with vs delhi policeI attacked in self defence with a knife, when they started beating me in group after a argument regarding filing fir .And they made a false case and i was bailed on 28 August 2022. And they have not filled chargesheet till nowI need to travel in india regarding my work and last time i travelled, i was called by police stating that during election they have to jail criminals who are out on bail. My previous lawyer stated that even when there is any crime in my area they can call me to police station. I want to ask about legalities because when i am out of delhi, it waste my time and money to come back while i am no criminal. They harrased with physical violence me and i reacted in self defence.

Dear Client The Police has the powers to call you to the police station when you’re out on bail. The conditions largely depend upon the bail order that the magistrate must have passed. you should consider getting the FIR quashed. feel free to get in touch for further discussions.

You can go to the high court for quashing of the FIR filed against you. Without any facts and baseless fir must be contested and quashed by the concerned high court of competent jurisdiction, provided you approach the high court with clean hands.

As such of you are out on bail police can’t send you to jail on statements that during election u need to go to jail ! You must file complaint against that police officer who stated such statement ! But indeed u must have evidences for your support ! However, it all Depends on the bail order of the court, if your bail order has a condition that you can’t come to that area during election then you can’t enter, if your bail order says that you need to give attendance in the police station every month etv than u need to come ! Police also maintain register of BC (Bad characters), if you were involved in previous offences then police might have entered your name in that register to call u to police station every time there is any crime in that area ! If u want to get your name removed from that register then u need to approach high court ! You need to hire expert advocate in this regard ! Be in touch Thanks
