Other party has started construction on my property what to do

sir, mainai apnai land par 144 kiya tha, par opposite party nai 24 december 2016 ko construction kar kai capture kar liya hai. police nahi aiyai. sir mai ab kya karu, please help me

immediately File an FIR and mention it in the letter that you informed the police and police did not come and send a copy to the commissioner also, and you must visit a good lawyer who can guide you in technically to deal the same and inform the same to the court over a petition.

If you have proper document then file a civil suit before the Court of appropriate jurisdiction and get a injunction. If construction made at the land then after getting the injunction order file a writ petition before Hon'ble High Court for demolition of unauthorized construction in others land or file a case u/s 156(3) and initiate criminal proceedings against opposite party.

MY OPINION THAT your legal steps are totally in vein for wrong doing by the opposite party as well as you should have so many ways to make objection and stop the construction on that place by using legal steps as early.

Carry your certified order under Section 144 to lodge an F.I.R. against the concerned party under section 447 I.P.C. for Criminal Tresspass and if u have tried to obstruct him and have recieved injuries in doing so carry your medical documents to supplement the charge with charges of grievous Hurt under section 325 I.P.C.

Agar apne obstruct kiya hai aur aapko injuries hai toh yeh apke liye faidemand hai kyunki reist karne pe agar apko chot aye toh Police immediate action leten hain.

If other party has captured your land inspite of drawing a procedure of 144 cr.p.c by constructing a wall thereon the only remedy is to file a suit under section 188 IPC which is due to the disobedience to order promulgated by a public servant alongwith relevant papers and documents.
