Need to file fraud complaint against relatives
04-Jun-2025 (In Criminal Law)
I am seeking legal assistance regarding a financial dispute involving my cousin's brother. I had lent him a significant amount of money, but he has repeatedly failed to repay it and is now refusing to return the funds. Additionally, he has been using emotional blackmail, including threats of self-harm, to pressure me into giving him more money. I have bank transfer statements and some WhatsApp messages as evidence. He has turned on disappearing messages on WhatsApp so our chats have been removed
Given the situation, consider the following steps:
- *Consult a lawyer*: Engage a lawyer specializing in financial disputes or civil litigation to guide you through the process.
- *Gather evidence*: Collect and preserve all relevant documents, including:
- Bank transfer statements
- WhatsApp screenshots (if available) or any other communication records
- Any other evidence supporting your claim
- *Send a legal notice*: Your lawyer can help draft and send a legal notice to your cousin's brother, demanding repayment.
- *Explore legal options*: Depending on the circumstances, you may be able to file a civil suit for recovery of the debt.
*WhatsApp's disappearing messages*: While the messages are no longer available, you can:
- *Check if any messages were saved*: If you or the other party took screenshots before the messages disappeared, those screenshots can serve as evidence.
- *Other communication records*: Provide any other communication records, like emails or SMS, that may support your claim.
Your lawyer can help you navigate the legal process, protect your interests, and work towards recovering the debt.
Dear Sir,
Bank transfers cannot be considered as exclusive evidence to recover the amounts paid by you. Such transfers must supported by security check, promissory note and/or agreement. Better lodge a complaint with Police of cheating and see that for the remaining balance amount you may take undated cheque from your opposite party and then file a cheque bounce case which is easy and will be decided within short time when compared to civil cases.
File a suit for recovery suit and also file a complaint of criminal intimidation vis a via threat of self harm that per se unlawful and offense and if you do these two simultaneously you will be able to stop him from demanding more money and and you have the possibility of getting money back and even if he does something like self harm you will will not in trouble.
