Section 319 CrPC petition filed in 2021 was closed as “not pressed” without a decision on merits, can a fresh petition be filed in 2026 while the main CC case is pending? Can the opposite party seek its dismissal through bare denials, disregarding the sworn statements, witness materials, and documentary and electronic evidence from proceedings under inquiry of Sections 200, 202 and 204 CrPC? Should the Court not consider the relevant materials on record instead of rejecting the fresh petition

ok ya the opp party cannot disregard the sworn witnesses the court should consider the all the evidence since closed and not pressed documentary evidence sections are thee relevant materials on record kindly see what will happen.
