Q: Weather To Include Children As Vendors Or Not

Seetappa gave a portion of property to govindappa through registered partition deed then govindappa give a portion of property to venkataswappa through registered partition deed then venkataswappa transferred portion of property to shridhar with exact boundaries through family registered partition deed now I am purchasing from shridhar ...shridhar has three children one major and two minor .... previously shridhar and wife masara entered in to sale agreement registered and canceled it in ec wife wife name reflects.......now how should I draft my sale deed should I take children and wife as vendors along with shridhar or confirming parties or should I exclude children ...........and take wife consenting witness

Advocate Narasimhachar M K answered
Given the complex family situation, it's essential to ensure all parties are involved to avoid future disputes. Here's a suggested approach:Since Shridhar has three children (one major and two minors), and the wife's name reflects in the EC, it's recommended to include all parties as vendors:- Shridhar (seller)- Shridhar's wife (consenting party or co-vendor)- Major child (co-vendor)- Minor children (represented by their guardian, likely Shridhar or his wife)Draft the sale deed with all these parties as vendors. This ensures:- The wife's interests are protected- The children's interests are protected (especially the minors)- The major child's consent is obtained- Shridhar's ownership is validatedAdditionally:- Obtain a No Objection Certificate (NOC) from the wife and major child- Ensure the minors are represented by a guardian (likely Shridhar or his wife)- Disclose the previous sale agreement and cancellation in the sale deedConsult a local lawyer to finalize the sale deed and ensure compliance with local regulations.
