My friend received a summon for 406,420,323,341,506 .


11-Sep-2023 (In Criminal Law)
She received a 2nd summon date to present in court but that date will be her delivery period and she will be in her maternity period.what will happen so court consider her maternity

If the summon as you said has come second time , then this should not be avoided because court can issue non bailable warrant for non appearance of accused. It's always better to engage a lawyer who can represent you and mark your appearance. Exemption from appearance can be sought on the maternity ground.

You can get the medical papers delivered to the court through your authorised advocate or any of her relatives because the court must be unaware of her situation and might get a warrant issued against her. For more legal assistance I am just a call away.

file exemption application along with medical documents court will consider... aap ko koi v free legal help leni ho toh contact krye Or please also tell from which court you receive notice and tell exact and clear facts of case than only a advocate help you completely.

in case of such maternity leave, she will have to fil an affidavit of maternity through her learned counsel. it is advised to take proper guidance before proceeding on the case and provide the complete detail to the advocate to file for an exemption

she has to be present in the court otherwise court will issue warrant agaist her the condition which you mentioned will be considered by the judge or court only if you advocate appreance on your behalf with relevant documents.
