murder case 302 can we get bail in this


11-Mar-2025 (In Criminal Law)
my brother has been arrested in murder case in 2020 he is in prison from last 4.5yrs.. But he has not done that murder even don't have proper avidence againest him.. If we apply for a bail can we get the bail... and how many days it me take to get him out in bail.. He has already spended his 4.5yrs without doing any crime.. please le me know how to bring him out of the prison

you can get a bail form High court after coplete the trails and then after you can get bail easily it can be posible to get bail in sission court but it may be after examination of some witness you can file a Bail pitition on high court nad sc also

what is the stage of the case if charge sheet has been filed and he has been sentenced by the court bail can be granted by honorable High Court. previously any application has been filed or not ?

According to your information, your brother has been in jail for 4-5 years that means your case is based on a total charges sheet by the police because if the charge sheet has a big role to bail grant accused that's why he can't get relief from bail The second thing is that if your advocate does not present the case properly and arguments , it's also a reason if this is not, then your brother can get relief by point of the merit basis when the case is closed.
