Hi sir , I am a poor man . I bought a wagonR of commercial permit in installments in 2016 january. And I sold it to a person in 2017. But the permit was not transferred in his name due to the remaining installments. And somehow only he have the agreement papers. Now he hit a man with the vehicle and ran from there. And due to me being the owner of the vehicle , a fir has filed against me. The vehicle was attached with OLA and UBER during this period. Can you suggest me something.Please it will be a great help. Thanking you .
Since F.I.R has been filed, we have to approach the Honourable High Court for the quashing of the F.I.R stating that the transfer of movable property was done much before but ultimately the name was not mutated in the registry. No ingredients of section 40 of IPC is fulfilled and therefore, the F.I.R shall be quashed and registered in the name of person who is now the real owner of the movable property.
