Legal Remedies Available: 1. Civil Action – Recovery Suit: File a Money Recovery Suit under Order 37 of CPC (summary suit) in Civil Court or City Civil Court if the amount is high. You must attach: Bank transfer proof. Chat/WhatsApp/email records confirming it was a loan. Legal notice sent earlier (if any). This is the most direct and effective route for recovery. 2. Criminal Action – Cheating (optional): File a police complaint under Sec 420 IPC (cheating), if: The borrower took money with fraudulent intent of never repaying. You have proof of false promises. But note: Police may not always act unless the criminal intent is very clearly shown. --- 3. Preventing Retaliation or Defamation: If they try to intimidate, harass or defame: Record incidents/messages (screenshots, audio, CCTV if available). File a complaint to police under: Sec 504 IPC (intentional insult to provoke breach of peace), Sec 506 IPC (criminal intimidation), Sec 499/500 IPC (defamation). If threats are serious, seek a restraining/stay order or injunction from the court. --- Suggested Next Steps: 1. Send a legal notice demanding repayment with all proof enclosed. 2. If no response, file: Civil recovery suit, Police complaint if cheating or threats are evident. 3. If harassment escalates, file a criminal complaint or approach the Magistrate for protection.
