Mental harrasment at work place by family lady.

Sir we have a paternal property which ia unsetelled till date and we have been using that property since 30 years and have a shop there. Since last 15 days one of my uncles laughter is harrasing us daily and has also put lock in shop. Now we are helpless as in past she has also accused us of false rape against her. How can i tackle her and avoid procecution if she files a false case again.

You have two cases One is civil other is criminal. For civil dispute you have to give the family branch below the ancestor person whose property you are using and in dispute, and file a civil suit if you have merits . Secondly as far as false criminal complaint is concern you need to apply for a anticipatory bail if FIR filed against you, or according the situation and face the trial.

If it's a parents self acquired property, after their demise all the legal heirs have got equal rights over all the properties. If the daughter of your uncle comes forcibly and lock the shop file an fir before your concerned police station for such harassment.

Before she files a false complaint against u near the police you make sure that u register a complain against them near the police and make all the allegation about the false case with which they are threatning you . Try to register a case dairy which will help you in getting anticipatory bail if any false cases are filed against you.

First of all you go to police station and give a complaint that she is black mailing us if you have any video recording present that as your proof.make a station dairy keep a copy of your complaint and the station dairy details. Contact me next step will be discussed in my chamber

For settling your legitimate share you haveto file a title suit and partition impleding all share holders claiming your 30 years possession.File anFIR in the local police station with a copy to SP on false case filed against you and life risk for safety and protection.For inaction of police you may file CRLMC in High Court.
