Q: Can I file litigation expenses if I am employed during my divorce case
My husband applied for divorce and I am supposed to contest now. Can I apply for litigation expenses even if I am employed but very less income than my husband? How much is usually granted for litigation expenses and lawyer fees etc? Am I eligible for maintenance and interim maintenance in spite of professional qualification and employment status? My income is only 10% of his total income
Advocate Kaushik Swain answered
yea you are eligible for maintenance and you can claim for the money you have invested in the case,if the husband wants divorce then he has to pay alimony unless its a special case where you are caught with someone while cheating your husband etc

We are Hindu. My daughter got married in Feb. 2018.From the 3rd month of marriage groom's family started teasing and torturing my daughter creating false accusations on facebook friendship, mainly for money. In 2019 Jan. daughter and son in law remained separated for 50 days. Then after compromise between both families she went. Again from 6 th July she is with us. Son in law is outside Odisha now since July 11 th for higher study. Main reason her husband and in laws want their dicttership to the extent of 95% in every respect. No value of her saying or of ours. There is severe incompatability. Under such circumstances and we strongly feel the son in law is a psychopath, how can she be legally separated at the earliest. We need only the amount transferred th. Bank and materials given. No intention to file any cases or FIR or compromise th. family court. Kindly advise.
Advocate Kaushik Swain answered
then you can go for mutual divorce , it there is no compatibilty and there is no hope for a settlement in the future then there is no reason to save the relationship ,its better to go for a bright future than living In a dark present
