IPC 354 - Case registered in India - living in US - Advise please

Hi,
I live in USA. Someone from my village had registered a false case (IPC 354) against me and my wife in India and this had gone to the court a year back and since then they're issuing a NBW. But we're living in US.
Can you please advise on how long they can issue a NBW? Would they take any action on our passport if we don't appear in the court. please advise. Thanks

Dear Sir,
You are under dangerous situation unless you approach High Court and get a stay order on such criminal proceedings and also seek quashing of such complaint. If charge sheet is filed then red alert may be issued if so requested by the Public Prosecutor. If no charge sheet is filed then at the request of Police and under the forcing circumstances if created by the Complainant red alert may be issued.

I understand your questions you are strucking case under section 354 ipx you should take anticipatery bail it is important you take a bail after that you should apear regular bail for trial. court otherwise police have arrest you and it is effect for passport also if judge can give order cancel the passport so you should fallow the legal procedure with court .

You have to be cautious if court gets a knowledge that you are living in USA court will issue warrant through embassy and as per the procedures of state law in USA you will be deported back so consult any advocate and take a necessary legal based on your facts and circumstance of case
