Questions Answered by Advocate Hanumesh H N (700+ answers)

Q: Ownership Transfer After Father's Death

Property purchased in 2014. Joint ownership with my father. In 2021, I issued a PoA to my parents to act on my behalf to sell the property. Property is an apartment (B Khata on A Khata land). In 2024, my father passed away. Now I need to amend documents to change the ownership. I'm a Christian and an only child. Mother is living. What should I do?

Advocate Hanumesh H N answered
No need of rectification of deeds , your parents were only acting behalf of you to purchase and sell the property , if there is separate SPA or POA you can cancel the deed, also Khatha and revenue records may be rectified if it’s a bbmp property.

Q: Not paid dues of my consultancy over 25 lacs

I was engaged with the firm as full time consultant. Consultancy fee was 3lacs per month. Till Sep24 payment was regular. After that it was uncertain in every month by not paying full amount and they could pay in full till Dec24. But after that from jan25 to Aug25 they did not pay any amount. Again Sept and Oct25 they paid in full and after that they asked to resign and to join in their another sister organisation. I resigned and joined but they did not settle my dues over 25lacs in earlier org

Advocate Hanumesh H N answered
As you providing consultancy service it's not fall under employment or labour laws so you have to file recovery suits and kindly maintain necessary docuemntary evidence to prove the dues otherwise court will not grant relief.

Specific requirements for Karnataka (any state-specific documents like BHOOMI records, BBMP Khata certificates, or other Karnataka-specific documents)?4. How should I prepare/organize these documents before providing them to

Complete checklist starts from mother deed to present tax paid receipt to e khatha etc but it's varies from nature of property , commercial , plots , farm land , Authority approved sites etc so better find out nature of property and ask for the documents

Q: I am Separate my spouse last 4 years No Children Can I get Divorce

Hi, I am separated from my spouse and living alone for the last 4 years. I now want to move on in life.Do I need to legally file for divorce, or is this situation considered as automatic divorce after long separation in India? I have heard that if a husband and wife are not living together for 2 years, it leads to automatic divorce in India. Is this true or false? Please advise me on how many years of separation is equal to divorce in India and whether my case qualifies.

Advocate Hanumesh H N answered
There is no procedure or concept of automatic divorce in India, you have to approach the court for any relief and you have to establish the 2 years of separation, your opposite party may agree or contest the case of divorce .
