Ask the police SHO/Investigating Officer in writing at the police station and/or file an application at the trial court registry for certified copies; if you are the accused (and the victim represented by an advocate) the Bharatiya Nagarik Suraksha Sanhita (BNSS) requires the Magistrate to furnish free copies of the police report/chargesheet, FIR and witness'statements without delay and in no case beyond 14 days from your production or appearance (see BNSS s.230). [BNSS text PDF: https://www.mha.gov.in/sites/default/files/2024-04/250884_2_english_01042024.pdf] Courts routinely supply certified copies on payment of prescribed fees or by online e'filing/eCourts access for parties/advocates (see eCourts portal: https://ecourts.gov.in). Supreme Court authority holds that chargesheets are not public documents to be placed on websites, so general public download access is not permitted; only parties/ their counsel or those authorised by court/IO can get them. See Saurav Das v. Union of India (SC) (chargesheet not public). [Saurav Das judgment: https://indiankanoon.org/doc/198007204/] For statutory context on offences and evidence consult the Bharatiya Nyaya Sanhita (BNS) and Bharatiya Sakshya Adhiniyam (BSA). To download a chargesheet online, you typically visit the official website of the relevant court, police department, or the eCourts Services portal. You may need details like the FIR number or case information to search for the document.

Alternatively, the accused or their lawyer can request a certified copy of the chargesheet directly from the court where it was filed or from the investigating officer at the police station. Filing an RTI application at the District Police Headquarters is another way to obtain a copy.

Dear Friend, you can submit an affidavit along with a copy application to the concerned department to obtain the chargesheet copy. Alternatively, you can engage a lawyer, who can file an application under Section 24 of the Code of Criminal Procedure (CrPC) (Section 18 of the Bharatiya Nagrik Surksha Sanhita) to obtain the chargesheet for you. Your lawyer can also be appointed as a prosecution assistant or a special public prosecutor to represent you during the trial.

You have not mentioned whether you are the complainant or the accused. If you are the accused, the police will file the chargesheet against you, and you have a legal right to obtain a copy of the chargesheet when you appear in court on police summons. If you are the complainant, you must apply for a certified copy of the chargesheet in court by submitting an application to the concerned court.

A copy of the chargesheet can be obtained from the court clerk's department. You will need to fill out a form and affix the required court fees. If you apply on an urgent basis, you can get the copy within three days. Additionally, you need to pay a per-page charge for the copy. It is advisable to hire a lawyer for this process.

If you are named as an accused person in the chargesheet filed by the police, you have the right to receive a copy of the chargesheet along with all relevant documents, including witness statements and other annexed papers. You do not have to pay any charges for this, and the copy must be provided immediately after the chargesheet is filed, as per Section 207 of the Criminal Procedure Code (CrPC) (Section 230 of the Bharatiya Nagrik Surksha Sanhita).

Additionally, if you are looking for how to download a chargesheet online, you may check the official Maharashtra police portal or court websites for online availability. For chargesheet download online in Maharashtra, visit the official police or judicial website to see if your chargesheet is available for online access.
