Sexual Harassment at Workplace

The government of India had taken a number of steps over the past decade to curb the menace of sexual crimes against women, one of which was the introduction of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act in 2013. This act was aimed at securing a safe and healthy workplace environment for women across both private/public and organised/unorganised sectors of the economy to overcome all hurdles for gender equality at the workplace.

The act gave a legal definition to sexual harassment at workplace to include any and all unwelcome acts and/or behaviour, both expressed or implied such as:

  • Unwanted physical advances and/or contact

  • Demanding sexual favours

  • Showing pornography

  • Any verbal or non-verbal conduct of a sexual nature

Further, the act mandated setting up of internal complaints committees within organisations and also the local complaints committees in each district to provide a redressal forum to aggrieved women and to ensure that their complaints are acted upon by the authorities. Interestingly, the redressal mechanism under the act is not a substitute to filing an FIR with the police authorities, thus a victim of sexual harassment at workplace can simultaneously register a complaint with the complaints committee and file an FIR if she so chooses.

What is SHe-Box?

In furtherance of the same goal, the government of India introduced another tool in the form of the ‘Sexual Harassment electronic Box’, better known as the ‘SHe-Box’ to establish an online redressal mechanism for the disposal of complaints of sexual harassment arising out of the workplace.

The SHe-Box provides single window access to all working women of the nation to a complaint registration and redressal mechanism. The SHe-Box facilitates easy and prompt submission of sexual harassment complaints to the relevant authorities in the respective jurisdictions, to ensure swift action and delivery of justice.
