How can I withdraw the case for the FIR i had filed

when mobile was stolen by someone. some people said this man is stolen your phone. I caught that man and took him in police station. police asked about phone he told them about phone after that police recovered the phone .and said me to field fir against him ,I field fir .after 1 year I got a call from court for witnesses, on 27-01-2017 but I do not want go in court I want to withdraw my case .can I withdraw it? and how

Dear Concerned,

Technically you can not withdraw but what you should be doing is on the date of hearing file an affidavit that the mobile was stolen and you were able to recover it with the help of the police and hence you are not interested to pursue the complaint and you do not have any issues with the thief as well and hence the file may be closed as you do not want to pursue the matter.

If you want to withdraw it you have to go to court for witnesses,than you can say that you got your phone and want to close the case for final report .it is the only way to withdraw the case .so go for witnesses

As per Section 320 of Code of Criminal Procedure you can get the offences for theft compounded. It means that you can enter into compromise with the accused and after filing of the compromise deed the mater will be over.
