Helpers family filed a case against us what to do.

04-Jan-2023 (In Criminal Law)
My maidservant of approximately 60 years, passed away as she was unwell. We looked after her well during the whole period medicines, hospital expense and everything. Her family refused to even take care of her during her last days even though we said we would make a monthly paymenet for her upkeep. Now on her death they have accused us of killing her and have filed an FIR. What are the options available for us.

You will have to file a writ in the High court with a prayer for stay of arrest and in the meanwhile provide the requisite details to the concerned investigation officer so that the final report / chargesheet may be filed accordingly.

Sir, if FIR has been lodged against you in UP, you may move a writ petition for quashment of FIR and most probably your arrest would be stayed and as per assertions, it appears that there is no direct or indirect evidence against you, if possible following the ratio of Bhajan Lal's case, FIR may be quashed.
