Hello I have been charged under 420 ipc along wtih 2 other director


22-Dec-2023 (In Criminal Law)
however we 2 directors are ready to compromise however session court asking to produce the witnesses we have provided a deed with signature of all the witness that our compromise has been done. Still session court asking for them we move to high court with 482 crpc. High court has directed that decide 320(2) before proceeding for the trail still session judge want witness to be present in the court. Please help

I think that ur counsel is unable to convince the court about the law and also about the order of high court. The order of high court if it has directed for deciding the application on 320 (2) is binding on the lower court . Contact me for any help.

If High Court has ordered the lower court to decide 320(2) before evidences, then court has to comply with it. If they don't, file a contempt case against the lower court judge in the high court. For further guidance in your matter please visit my office by taking a prior appointment.

you have not mention the section under which offence you want to compromise and said offence is compoundable or not , because if said offence is not compoundable then trial court without witness examine did not closed the matter

now you can file a fresh application of 320(2) before session court with a copy of high court order. if still the session court denies to entertain the matter you can again seek high court interference to change the presiding officer in the session court
