FIR registration enquiry expert advise

Hi, Pls. note that A and B are father and Son and A got the FIR registered against a women’s say C in evening of occurance of incidence and C after knowing that file molestation against A son ie B on next day. Pls confirm and give ur opinion if police has right to registered C FIR without any evidence. Also note that A has got the Complaint registered against C before filing of current incidence FIR as well.

Regarding your query.

Unfortunately, when a woman makes a complaint of molestation, the police are bound down to register a complaint and subsequently an FIR. She will be required to depose under Section 161 of the CrPC and thereafter provide her statements to the Hon'ble Court under Section 164. Evidence will also have to be collected in this regard.

However, it should be brought immediately to the Court's notice that she is indulging in a counter-blast to to your complaint. You will receive summons and depending on the circumstances/evidence if any at all will have to be seen.

You should immediately speak with a lawyer upon receiving the summons and should obtain a copy of the FIR lodged against you.
