Filing of complaint to register ipc 211 against those who filed false

28-Jul-2025 (In Criminal Law)
Will the Police accept my complaint to file FIR with section 211 against my wife who filed false criminal cases when still that case is at the trial stage in court. I have solid proof to prove my innocence. If the Police is reluctant to take my complaint, what should I do?

Under Section 211 IPC, filing a false criminal case with intent to cause injury is punishable, but proving it requires that the original case be found false by a competent court. Since the case is still at the trial stage, the police may not file an FIR under Section 211 yet. However, if you have strong documentary proof of your innocence and malicious intent by your wife, you may submit a written complaint to the police. If they refuse to register an FIR, you may approach the Magistrate under Section 156(3) CrPC and seek directions for registration of FIR.

At this stage, the police will not register an FIR under Section 211 IPC against your wife, because the law requires that the case she filed must first end in your favour, only then can it be said to be false or malicious. Until the trial concludes, no action under Section 211 can legally lie. Your priority should be to contest that case with full force and place your evidence on record. Once the court records a clear finding in your favour, you can file a complaint with the police. If they still refuse to act, approach the Magistrate under Section 156(3) CrPC or file a private complaint under Section 200 CrPC. That is the proper legal recourse and the remedy. If you require further legal assistance, feel free to get in touch.

You cannot proceed under s.211 IPC while the case is pending. Currently, you can defend yourself strongly before the court, get acquitted based on merits then you can approach either police or magistrate under s. 200 CrPC with a complaint under s. 211 IPC
