Q: Do we need any lawyer to get the bail from police station
Do we need any lawyer to get the bail from police station in any cognizable offence or get the same without involving the lawyer ?
Advocate Amit Kumar Sharma answered
The police cannot give regular bail after arrest in a cognizable offense. They may sometimes release a person before arrest, but once arrested, only a court can grant bail. To get bail from the court, you need a lawyer to file the application and represent you, as the process requires legal knowledge and court procedures.

Q: US Citizen - Visa Issues, Need Urgent Medical Return to India
I spent 183 days in India in 2025 on tourist e-visa (over 180-day limit, misunderstood rule). FRRO at Delhi airport issued exit permit for overstay. Applied for new e-visa—rejected after 1 week. Then applied for regular tourist visa in Kathmandu. After 1 month, not rejected but told by phone “cannot issue approval,” advised to apply for medical e-visa or at US embassy. Portal still shows “Under Processing.” My SOP states I’ll register with FRRO on return.
Advocate Amit Kumar Sharma answered
If you have overstayed your 180-day limit on an Indian e-tourist visa even due to a genuine misunderstanding the overstay is logged by Indian immigration authorities and may result in rejection of future e-visa applications, despite being issued an exit permit by the FRRO without penalty. While your willingness to register with the FRRO on re-entry reflects good faith, tourist visa holders are generally not eligible for such registration unless the visa permits longer continuous stays. The Indian Mission in Kathmandu may hesitate to process the regular tourist visa due to this prior record, even if no formal rejection is issued. In such cases, it is advisable to apply for a medical or entry visa categories which allow FRRO registration and are treated more leniently in re-entry scenarios or approach the Indian Consulate in your home country (e.g., the U.S.) where missions have broader discretion to consider past overstay with supporting documentation, including the FRRO’s exit permit.
Q: General query on hearing fees..,.
Mera case already delhi high court me chal rha and per hearing charges is 1.2 lakh but jab court ne next date di thi us din hamara number aaya nhi and fir next date de di gyi...aise me hume lawyer ko fees deni padegi kya? Kyunki arguments kuch hua he nhi..number he nhi aaya and next date de di gyi hai...Lawyer ko 1.2 lakh dena padega ?
Advocate Amit Kumar Sharma answered
Thank you for your query. In High Court matters, it is standard practice for a lawyer to charge for each appearance, as their time is allocated and they must be prepared to argue the case. The fairness of the fee depends entirely on the terms of your initial understanding or agreement. Given the repeated ineffective dates, it is both reasonable and your right to seek clarification from your counsel regarding the billing structure and the status of your case. As legal professionals, we have a duty of transparency to our clients. If you require an independent assessment or a second opinion on the matter, I am ready to give my assistance.
