Family Welfare Committee against registering FIR u/s 498A & 406 IPC
20-Jan-2023 (In Criminal Law)
Dear sir I made a complain to police for registering fir for 498a and 406 ipc. Dsp level officer investigated and recommended to register fir against husband and his family members but family welfare committee did not recommend.now what can I do to register fir
Firstly see the recommendation of the SSP and if he doesn't then file application before the judge by engaging advocate to direct the police to Register FIR against the persons in accordance to the offence committed by them.
Dear questioner, this is the latest guidelines issued by honourable Supreme Court of India that without the opinion of family welfare committee FIR can not be registered.
So there is no other method.
This procedure has been adopted because of false cases and misuse of section 498-A by the wife is much more frequent these days.

As per ruling of Hon'ble Apex Court police cannot direct register FIR u/s 498of IPC nor she can arrrset to husband and their relatives. So matter will be inveatigate by the policeby calling both of the parties and aftet satisfacation, police will send its recommendation to Distt. Legal aid services authorities to register FIR.
File a complaint in court or an application u/s 156(3) of cr. P. C in which court will seek report from police and after examining it can direct police to register fir or can supply motto take action by treating the application as complaint
