Q: How to claim my car from police custody

Hi, I want to register a Fir against my business partner who forcefully had kept my car with him and was not returning. I gave an application to SSP in this regard and then he had to bring back the car. Now the car is in the police custody at on of the police stations. This car is registered in my sisters name and I have the custody of the car for the past 8 years, after my sisters marriage. She is a working woman and cannot come to bathinda now and then so can I give the statement on her behalf to the police by taking special power of attorney from her?

As per your query you have to get court order for releasing vehicle kept by police for that you have to angage a lawyer who will file application for SAPURDARI of vehicle I.e. PB After that court will pass an order and direction to SHO of concerned police station for relasing the vehicle.



Q: Cheque given as security for money borrowed by person before death

My father died few weeks ago and today a person came to me and said that my father have taken 20000 rupees as debt and given a security cheque to him. That person said my friends's father was witness in this. I didnt knew anything about this before . Plz suggest me what should i do now?

As per law security cheque is also fall under/sec 138 of NI Act. You have remedy that. firstly you ask that about his dealing with your father, also check account books so that it may clear that what kind of payment had to paid by ur father.

Dear sir my question is that what is the ipc section for abusive language on phone? and if someone abuse you then what to do legally?

Using abusing language is cover under defamation and accused is directly cover under sec 499 of IPC. As per Evidence Act phone recording is an electronic record and you may produce it in form of CD before Hon'ble Court and prove your version.



Q: Possibility of getting bail for case charged u/s 302 of IPC

My stepmom killed my grandfather 2 years ago and is in jail. A trial is still going on on her under ipc 302. She has applied for a bail in high court. Would she get a bail? If yes then under what conditions?

Murder u/s 302 of IPC is a non-bailable offence. In such kind of offences its is a matter of dicreation of the courts not a matter of right. So granting bail to accused is depend upon the court and she itself would see the nature of the offence and cirmustances arose at the of crime.
