Criminal Case Filled Against Brothers And Sisters

Father had purchased property in the name of mother in 1990 . Later mother got expired in 2005. Father got the property transferred to his name by producing death certificate of mother. And further father executed gift deed to all children excluding 1 child. Now after 10years of execution of gift deed . That one child has filled criminal case against remaining brothers . Saying Father was not well . So will this leads to any problem between remaining brothers and sisters. He has filled PCR and following sections 420, 120b , 471 and other. So what has to be done

You will have to contest the case and counter the allegations levelled against you all. If he has filed a private case under 200 of criminal code and you received a summon then you may challenge the issue process through yourr counsel.

Hello, It seems that he has registered a complaint under these mentioned sections for forgery. It is very difficult to prove this but has to be proven through technical expert witness and its report. Property can be challenged under Civil Suit only No criminal case can survive

Well, by filing a FIR against all Brothers, he is trying to bring all brothers under pressure to give him something from the shares of the Property which they have got in Gift Deed from the Father. So, the solution of this problem is to lodge Counter FIR of Extortion against him on the basis of false Police Complaint. You can also lodge a case of Criminal Intimidation against him, so that, he come under pressure to withdraw Criminal Cases against all Brothers.
