If the bail is opted from sessions court and if police picks the accused without any warrant and detain him illegally then the contempt of court should be filed before the sessions court or high court by the way of writ ? And what is the time limit to file ?

hello Roy hru as ur saying the accused have got the bail from session court and still police has arrested the accused and put him behind the bars. in this matter you need to approach the high court immidiately. otherwise police can cook up the new story for doing so .

Time for contempt is 1 year. For immediate relief, immediately go file a writ of haebeas corpus. One year limitation period applicable for suo-motu contempt ... The complainant has to filed a petition to initiate contempt of court .

a writ can only be filed before the High Court or the Supreme Court of India. if the bail is already granted to the accused, the police officials cannot arrest/detain the accused unless some subsequent event has happened which was against the rules of bail being granted.

Dear client, Firstly you check , whether he has another case against him or the same case only in which he has been enlarged on bail, If so then writ is option, against IO or thana incharge. You may consult for the same.
