It is the matter of appreciation of evidence and if she successfully create such presumption then certainly she will proof her version but it is difficult to do so. If you provide the real time line list of fact then it will be more easy to give you a concrete reply.

Hi, This question is incomplete in itself as you have picked up only one line of the lady, where she alleged that a promise to marry was made to her over a phone. One must require other contextual facts to legally answer your question. If there existed a relation between the boy/girl, timelines of such relation and rights of the boy/girl in such relation will be considered by the court before considering evidence related to a disputed fact. For example, if boy/girl are meeting regularly and are in physical contact with each other, it becomes immaterial that girl was promised to marry only on phone. The girl can easily change her pleadings where she can allege that the promise to marry was made during a physical/virtual meeting. Note: The answer to the question should not be considered as rendering of a legal advice.

Promise to marriage can not be proved mechanically. One has to understand for the Promise to marriage, first, a relationship needs to be proved and once that relationship is proved then the promise to take that relationship to the next level i.e. marriage needs to be proved. Again the circumstances are predominant to prove that the parties engage themselves to marry and the reason for the relationship or any kind of cohabitation was for the marriage, the family whereabout and knowledge of the relationship, status of the parties and the factum of age all are considerable points.
