Based on your facts, your brother's act amounts to impersonation, cheating, forgery, and criminal breach of trust. Under BNSS, you may file an FIR citing the following provisions under Section 316, 336, 337, 308, 319 of BNSS. Since the police is refusing to register your FIR, file a written complaint to the SP/DCP under Section 173(3) BNSS, and if no action is taken, file a criminal complaint before the Magistrate under Section 175 BNSS seeking direction to register FIR. Also gather and preserve all documents like your firm’s registration, bank records, account opening forms, and any written communication to strengthen your case.

If a genuine fraud has happened with you, you should immediately file a complaint with the police (preferably drafted by a lawyer) and also, notify the bank. If not done, the bank may come after guarantor and recover money from the guarantor.

In case they aren't registering FIR you can approach a lawyer to draft a proper complaint along with relevant sections and file it with Magistrate directly. It's a clear case of identity theft under the IT act along with fraud and cheating. If you have any questions feel free to contact me.
